User Agreement Terms and Conditions
The Fixeo terms & conditions outline Fixeo's and Your obligations and responsibilities on the Fixeo Platform.
User Agreement: www.fixeo.co.uk, www.fixeo.ae / Fixeo iOS/Android App.
Fixeo operates an online platform allowing Users to connect through the Fixeo Platform with other Users who provide Services.
Please read these terms and all Policies including the Community Guidelines carefully before using the Fixeo Platform. These Policies are incorporated into this Agreement.
1. Scope of Fixeo Services:
- 1.1 Fixeo provides a platform for clients to publish jobs and fixers to offer their services.
- 1.2 Clients can modify or revoke a job before accepting an offer.
- 1.3 Once a client accepts an offer, a job contract is created, and the agreed price must be paid into the payment account.
- 1.4 Fixeo services are rendered upon the creation of the job contract, and a service fee is due.
- 1.5 The job contract cannot be changed on the Fixeo platform once created, but additional work requires a new job.
- 1.6 Clients must provide notice of completion on the platform.

- 1.8 Users are encouraged to review and provide feedback on the platform.
2. Fixeo's Role and Obligations:
- 2.1 Fixeo provides the platform for users to publish jobs and make offers.
- 2.2 Only individuals over 18 years of age can register as users.
- 2.3 Fixeo reserves the right to refuse registration, cancel/suspend accounts, or remove posts/offers if user conduct is detrimental to the platform's operation.
- 2.4 Registering and creating an account with Fixeo is free.

- 2.6 Fixeo does not warrant the truth or accuracy of information provided by users.
- 2.7 The Fixeo service is provided "as is" without any warranty, except for liability in relation to any Non-excludable Condition.

3. USER OBLIGATIONS
- 3.1 You are obligated to:
- Comply with the Agreement, including all policies, as well as applicable laws and regulations.
- Provide accurate information on the Fixeo Platform.

- 3.2 Content Usage:
- You agree that any content on the Fixeo Platform cannot be used on third-party sites or for other business purposes without prior permission from Fixeo.
- 3.3 Prohibited Use:
- You must not use the Fixeo Platform for illegal or immoral purposes.
- 3.4 Account Control:
- You are responsible for maintaining control of your Fixeo account and should not allow others to use it.
- Sharing, transferring, or selling your account or its content to another person is prohibited.
- 3.5 License Grant:
- You grant Fixeo a worldwide, royalty-free license to use, reproduce, modify, and adapt any content and information posted on the Fixeo Platform.
- This license allows Fixeo to publish material, provide the Fixeo Service, and promote the service.
- 3.6 Harmful Content:
- You agree that any information posted on the Fixeo Platform must not be potentially or actually harmful to Fixeo or any other person, including causing economic loss.
- 3.7 Information Accuracy and Legality:
- Information you provide to Fixeo or publish in a job must be up to date and accurate.
- The information must not be false, misleading, fraudulent, involve counterfeit or stolen items, infringe on third-party rights, violate applicable laws, be defamatory, obscene, or contain malicious code.
- 3.8 Privacy and Personal Information:
- The Fixeo Platform has location-based functionality, but you should never disclose personal details such as full name, address, phone number, or email address in a job or public communication on the platform.
- 3.9 Fixer Responsibilities:
- If you are a fixer, you must have the right to provide services under a job contract and comply with tax and regulatory obligations.
- You should work in the jurisdiction where the services are performed.
- 3.10 No Additional Fees:
- When supplying services, you must not charge clients any fees on top of the fixer funds, except when the parties agree to amend the agreed price through the platform.
- 3.11 Payments and Reimbursement:
- You must not request payments outside of the Fixeo Platform from the client for services, except as permitted by clause 3.12.
- If a fixer agrees to pay for costs related to completing the services, they are responsible for obtaining reimbursement from the client.
- 3.12 Subcontracting and Third Parties:
- If a fixer subcontracts part of the services to a third party with the client's consent, the third party must also be a registered user of the Fixeo Platform.
- 3.13 Consequences of Breach:
- If Fixeo determines that you have breached any obligation under clause 3 or Job Contracts, it reserves the right to remove content, jobs, offers, or cancel/suspend your account and/or any Job Contracts.
- 3.14 If Fixeo determines at its sole discretion that You have breached any obligation under this clause 3 or that You have breached one or more Job Contracts, it reserves the rights to remove any content, Job or Offer You have submitted to the Fixeo Service or cancel or suspend Your account and/or any Job Contracts, as indicated by clause no 2.3
4. Fees
- 4.1 Fixeo platform is free of charge service till further notice to both, Clients and Fixers.
- 4.2 Clients pays directly to Fixer upon completion of the job
- 4.3 If Fixeo introduces a new service on the Fixeo Platform, the Fees applying to that service will be payable as from the launch of the service.
- 4.4 Fixeo may restrict a User's account until all Fees have been paid.
5. PAYMENTS AND REFUNDS
- 5.1 If the Job Contract is canceled by the Client for any reason two hours before the commencement time, Client must pay reasonable charges for the Fixer e.g. call out charges
- 5.2 If the Job Contract is canceled by the Fixer for any reason two hours before the commencement time, the Client must report it to Fixeo to take necessary actions against the Fixer which could result in cancellation of the Fixer’s account.
6. BUSINESS PARTNERS
- 6.1 Fixeo may enter into agreements with Business Partners and may seek to engage Fixers in the provision of Business Services. Fixers who agree to perform Business Services for Business Partners acknowledge and agree that Fixeo and the Business Partner may on-sell Services supplied to third parties for an increased fee.
- 6.2 Business Partners may require Fixers providing Business Services to be approved or hold particular qualifications. Fixeo may assist Business Partners to locate suitably qualified Fixers. Fixeo makes no warranty that it will promote any or all suitably qualified Fixers to Business Partners.

6.4 Where a Fixer accepts a Job with a Business Partner:
- the Fixer must provide Business Services to the Business Partner in accordance with the Job Contract and any applicable Business Partner Contract; and
- the terms of the Business Partner Contract will prevail to the extent of any inconsistency.
7. THIRD PARTY SERVICES
- 8.1 Fixeo may from time to time include Third Party Services on the Fixeo Platform. These Third Party Services are not provided by Fixeo.
- 8.2 Third Party Services are offered to Users pursuant to the third party's terms and conditions. Third Party Services may be promoted on the Fixeo Platform as a convenience to our Users who may find the Third Party Services of interest or of use.
- 8.3 If a User engages with any Third Party Service provider, the agreement will be directly between the User and that Third Party Service provider.
- 8.4 Fixeo makes no representation or warranty as to the Third Party Services. However, to help us continue to improve our Fixeo Platform, Users may inform Fixeo of their Third Party Service experience here (info@fixeo.co.uk)
8. VERIFICATION
- 9.1 Fixeo may use Identity Verification Services. On the other hand, the Users are obliged to provide their real identities and accurate details during the registration to the platform and any otherwise false information will be deemed as a breaching of Fixeo’s Terms and Conditions, which might result in cancellation of the account and/or liability under the applicable law for any harm caused by this action.
- 9.2 You agree that Fixeo Identity Verification Services may not be fully accurate as all Fixeo Services are dependent on User-supplied information and/or information or Verification Services provided by third parties.
- 9.3 You are solely responsible for identity verification and Fixeo accepts no responsibility for any use that is made of an Fixeo Identity Verification Service.
- 9.4 Fixeo Identity Verification Services may be modified at any time.
- 9.5 The Fixeo Platform may also include a User-initiated feedback system to help evaluate Users.
9. FEEDBACK
- 10.1 You can complain about any comment made on the Fixeo Platform using the 'Contact Us' option on the mobile app function or email “info@fixeo.co.uk”.
- 10.2 Fixeo is entitled to suspend or terminate Your account at any time if Fixeo, in its sole and absolute discretion, is concerned by any feedback about You, or considers Your feedback rating to be problematic for other Fixeo Users.
10. LIMITATION OF LIABILITY
Please see Your Country Specific Terms for the applicable exclusions and limitations of liability.
11. PRIVACY
- 12.1 Third Party Service providers will provide their service pursuant to their own Privacy Policy. Prior to acceptance of any service from a third party, You must review and agree to their terms of service including their privacy policy.
- 12.2 In order to ensure Fixeo can reduce the incidence of fraud and other behaviour in breach of the Community Guidelines, Fixeo reserves the right to ask Users to verify themselves in order to remain a User.
12. MODIFICATIONS TO THE AGREEMENT
- 13.1 Fixeo may modify this Agreement or the Policies (and update the Fixeo pages on which they are displayed) from time to time. Fixeo will send email of such modifications to your email address.
- 13.2 When You actively agree to amended terms (for example, by clicking a button saying "I accept") or use the Fixeo Platform in any manner, including engaging in any acts in connection with a Job Contract, the amended terms will be effective immediately. In all other cases, the amended terms will automatically be effective 30 days after they are initially notified to You.
- 13.3 If You do not agree with any changes to this Agreement (or any of our Policies), You must either terminate your account or You must notify Fixeo who will terminate Your Fixeo account, and stop using the Fixeo Service.
13. NO AGENCY
- 14.1 No agency, partnership, joint venture, employee-employer or other similar relationship is created by this Agreement. In particular You have no authority to bind Fixeo, its related entities or affiliates in any way whatsoever. Fixeo confirms that all Third Party Services that may be promoted on the Fixeo Platform are provided solely by such Third Party Service providers. To the extent permitted by law, Fixeo specifically disclaims all liability for any loss or damage incurred by You in any manner due to the performance or non-performance of such Third Party Service.
14. NOTICES
- 15.1 Except as stated otherwise, any notices must be given by email. Any notice shall be deemed given:
- 24 hours after email is sent, unless the User is notified that the email address is invalid or the email is undeliverable, and
- 15.2 Notices related to performance of any Third Party Service must be delivered to such third party as set out in the Third Party Service provider's terms and conditions.
15. MEDIATION AND DISPUTE RESOLUTION
- 16.1 Fixeo encourages You to try and resolve disputes (including claims for returns or refunds) with other Users directly. Accordingly, You acknowledge and agree that Fixeo may, in its absolute discretion, provide Your information as it decides is suitable to other parties involved in the dispute.
- 16.2 If a dispute arises with another User, You must cooperate with the other User and make a genuine attempt to resolve the dispute.
- 16.3 Fixeo may elect to assist Users in resolving disputes. You must cooperate with any investigation undertaken by Fixeo. Fixeo reserves the right to make a final determination (acting reasonably) based on the information supplied by the Users and direct the Payment Provider to make payment accordingly. You may raise your dispute with the other User in an applicable court or tribunal if you are not satisfied with the outcome of Fixeo’s determination. Upon submitting the final decision of the applicable court of tribunal, Fixeo will implement the decision accordingly
- 16.4 Disputes with any Third Party Service provider must proceed pursuant to any dispute resolution process set out in the terms of service of the Third Party Service provider.

16. TERMINATION
- 17.1 Either You or Fixeo may terminate your account and this Agreement at any time for any reason.
- 17.2 Termination of this Agreement does not affect any Job Contract that has been formed between Fixeo Users.
- 17.3 Third Party Services are conditional upon, and governed by, Third Party Service provider terms and conditions.
- 17.4 Sections 4 (Fees), 11 (Limitation of Liability) and 16 (Mediation and Dispute Resolution) and any other terms which by their nature should continue to apply, will survive any termination or expiration of this Agreement.
- 17.5 If Your account or this Agreement are terminated for any reason then You may not without Fixeo's consent (in its absolute discretion) create any further accounts with Fixeo and we may terminate any other accounts You operate.
17. GENERAL
- 18.1 This Agreement is governed by the laws specified in Your Country Specific Terms.
- 18.2 The provisions of this Agreement are severable, and if any provision of this Agreement is held to be invalid or unenforceable, such provision may be removed and the remaining provisions will be enforceable.
- 18.3 This Agreement may be assigned or novated by Fixeo to a third party without your consent. In the event of an assignment or novation the User will remain bound by this Agreement.
- 18.4 This Agreement sets out the entire understanding and agreement between the User and Fixeo with respect to its subject matter.
